These Terms of Service (“Terms”) govern your access to and use of TableEasee. By accessing or using the TableEasee service, you agree to these Terms. If you do not agree, do not use the service.
1. What TableEasee Does
TableEasee provides technology that allows users to join and monitor restaurant queues and receive related notifications.
TableEasee is not a restaurant and does not own, operate, manage or control participating restaurants.
2. Queue Service Is Not a Reservation
Joining a TableEasee queue does not guarantee:
- a particular waiting time;
- a specific table or seating arrangement;
- immediate seating;
- a particular queue position at every moment; or
- that a restaurant will ultimately be able to seat your party.
Queue positions, waiting times and status information may be estimates and may change as restaurant conditions change. Participating restaurants remain responsible for seating decisions, operating hours, capacity, table allocation and management of their queues.
3. Restaurant Information and Responsibility
Participating restaurants are independently responsible for their own food, beverages, prices, service, premises, staffing, safety, accessibility, allergens, operating hours and customer experience. Restaurant information shown through TableEasee may be supplied by restaurants or third-party sources and may change without notice.
TableEasee is not responsible for a participating restaurant’s products, services, omissions, conduct or decisions, except to the extent that applicable law does not permit such responsibility to be excluded or limited.
4. SMS Notifications
Where you expressly opt in, TableEasee may send SMS messages concerning the queue you joined, including queue confirmation, queue-status and table-ready updates.
Message frequency varies and standard message and data rates may apply. You can reply STOP to stop messages or HELP for assistance. If you stop SMS messages, you may need to check your queue status through other available methods.
For assistance with TableEasee SMS notifications, contact support@tableeasee.ca.
5. Your Responsibilities
You agree to provide reasonably accurate information and to use only a phone number that you are authorized to use. You must not:
- misuse, damage, disrupt or interfere with the service;
- create fraudulent, intentionally misleading or abusive queue entries;
- attempt unauthorized access to TableEasee systems, accounts or data;
- impersonate another person or misrepresent your authority to use a phone number;
- circumvent security, technical or usage controls; or
- use TableEasee for unlawful purposes.
We may remove queue entries or restrict access where reasonably necessary to protect users, participating restaurants, TableEasee systems or the integrity of the service.
6. Availability and Third-Party Services
TableEasee may rely on third-party telecommunications, hosting, database, mapping, internet and other technology services. We do not guarantee that TableEasee will be uninterrupted, error-free, secure or continuously available. Notifications, queue information or other features may occasionally be delayed, unavailable or inaccurate for reasons outside our reasonable control.
7. Intellectual Property
The TableEasee name, software, interfaces, graphics, branding, designs, documentation and other TableEasee-owned materials are protected by applicable intellectual property laws. Your use of TableEasee does not transfer ownership of those materials to you.
Subject to these Terms, TableEasee gives you a limited, revocable, non-exclusive and non-transferable right to use the service for its intended personal purpose.
8. Privacy
Our collection, use, disclosure and protection of personal information is described in the TableEasee Privacy Policy, which forms part of these Terms. Privacy-related enquiries should be directed to privacy@tableeasee.ca.
9. Disclaimer and Limitation of Liability
To the maximum extent permitted by applicable law, TableEasee is provided on an “as is” and “as available” basis, without warranties or conditions beyond those that cannot legally be excluded.
To the maximum extent permitted by applicable law, TableEasee will not be liable for indirect, incidental, special, exemplary or consequential losses arising from or related to the use of the service, restaurant operations, queue estimates, delayed or failed notifications, third-party services, or service interruptions.
Except for liability that cannot legally be limited or excluded, TableEasee’s aggregate liability arising from a consumer’s use of the service will not exceed CAD $100 or the amount the consumer paid directly to TableEasee for the service during the 12 months before the event giving rise to the claim, whichever is greater.
Nothing in these Terms excludes, restricts or waives any statutory consumer right, remedy or liability that cannot legally be excluded, restricted or waived.
10. Responsibility for Unlawful Misuse
To the extent permitted by applicable law, you are responsible for losses, claims or reasonable costs directly resulting from your fraud, unlawful conduct, unauthorized access, or deliberate misuse of TableEasee.
11. Changes, Suspension or Termination
We may update, modify, temporarily suspend or discontinue parts of TableEasee where reasonably necessary for operational, security, legal or business reasons. We may also restrict or terminate access for serious or repeated misuse of the service.
We may update these Terms from time to time. The updated effective date will appear at the top of the Terms, and we will provide any additional notice required by applicable law for material changes.
12. Governing Law
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada. Any mandatory consumer protections, jurisdictional rights or other rights that apply to you remain unaffected.
